Isla Escape Cottage - Terms and conditions 
General terms and conditions (Isla Escape.com) Object of rental These general terms and conditions are, unless specifically mentioned otherwise, valid for the rental of the beachfront cottage "Isla Escape" hereinafter referred to as "Object" and as further specified in the web site Isla Escape.com. Owner The owner of the Object is no party to this or any other rental agreement concerning the rental of the Object. The principle responsible and his party shall protect and hold harmless to the owner against any claim and/or damage that may be attributed to the rental and the use of the Object. Definitions "Principle responsible" means the principle responsible person entering into this rental agreement also on behalf of his party. "Party" means the occupants of the object under this rental agreement. "Object" means the Isla Escape beachfront cottage, located at Akumal, Quintana Roo, Mexico, including its inventory. "Agreement" means the agreement for the rental of the Object including the terms and conditions. Payment terms and conditions Reservations require payment of the full rental charge within 10 working days from the date of transmission of the e-invoice 'Down payment may be made through the PayPal facility available on the reservation page of the Isla Escape website.' and, unless specifically agreed in writing otherwise, minimum 60 days prior to the arrival date. Payments should be made by bank transfer as detailed in the e-invoice. Reservations made within the period of 60 days prior to arrival require payment in full within 10 working days from the date of transmission of the e-invoice. Damage deposit No "damage deposit" is required. However, in the event that the damage is occurred to the Object beyond normal wear and tear and caused by the party, Isla Escape.com reserves the right to charge the principle responsible or its party for the replacement/repair cost incurred. The Object shall be treated by the party in a way as that of a good housefather. Cancellation Cancellations should be in writing by e-mail. Cancellations are effective from the date of receipt and acknowledgement of the cancellation. Cancellations before 41 days prior to the arrival date will result in the forfeit of one night’s rent. Cancellations 41 ~ 31 days prior to the arrival date will result in the forfeit of 50% of the rental amount. Cancellations 30 ~ 0 days prior to the arrival date are subject to no refunds. There are no refunds on national holiday reservation cancellations. Holidays Holidays are defined as follows: US thanks giving, Christmas, New years, US Washington's Birthday, Easter holiday Non-availability In case the Object is not available for occupancy due to acts of God, included but not limited to hurricane, floods, strikes, acts of terrorism or war, etc., the principle responsible and his party shall hold Isla Eccape.com, its personnel and agents harmless against any damage and or claim caused by such non-availability. In case of such event of non-availability, the principle responsible and his party agrees to accept full refund of the monies paid and waives any further recourse against Isla Escape.com, its personnel and agents. Maintenance and system failures Isla Escape.com exercises due diligence in the maintenance of the Object. Technical systems however may fail at the most inconvenient moments. In the event of system failure, the principle responsible shall forthwith inform the management of such a failure. The management shall take prompt action to resolve the shortcoming. However, the principle responsible and his party should understand that with regard to reparation, Isla Escape.com might be dependent on third parties for technical assistance and/or supply of parts and materials. Timely delivery of third party assistance is out of the control of Isla Escape.com. Quintana Roo is one of the fastest growing tourist destinations in the world and some times suffers from overloading of the infrastructure that may cause temporary failure of electricity or water supply. Emergency back-up systems are available but may cause some temporary inconvenience. Please note that no refunds are available to compensate for any inconvenience caused by system failures. Weather and construction disturbance Any adverse weather conditions are considered as an act of God. Although Isla Escape is located in a completed sub-urban area, construction disturbance may be caused by repair and maintenance activities to neighboring properties. These kinds of disturbances are beyond Isla Escape.com’s control and cannot demand compensation. Valuables Like at home, petty theft cannot be excluded. Use the safe available in Isla escape to store your valuables. The Isla Escape.com management will make the safe code available to you. Please do not leave any valuables unattended, do not leave money or valuables in sight. Isla Escape.com will not be held liable for any damage to or loss of property. When you leave the Object, all windows and door must be closed and locked at all times. Occupancy The maximum occupancy capacity of Isla Escape is six persons. No additional guests are allowed to be accommodated. Noise disturbance The Akumal beach area is known as a beautiful, quiet and relaxing part of the Mexican Caribbean. Visitors aim to enjoy the tranquility given by nature and breath-in the relaxing atmosphere. Visitors are requested to be considerate and limit disturbance of neighbors, in particular, after 10.00 pm. Parking and access Two parking spaces are available at the roadside in front of the Isla Escape property. Isla Escape has, for your protection and privacy its own access gate. The access gate must be closed at all times. Access by Isla Escape.com personnel The management and personnel of Isla Escape.com may enter the Object for routine maintenance, repairs and inspection. Such visits will be informed to avoid holiday disturbance. Maid service is rendered on a daily basis in the morning at 10 am with the exception of Sunday. Garden cleaning and maintenance is carried out on a regular basis during the week with the exception of Sunday. Inventory removal No inventory items shall be removed from the Object. When using beach towels, beach chairs, kayaks and peddles, at the end of the day or whenever the Object is left alone, inventory items shall be moved into the garden near the terrace. Under no circumstances, inventories shall be left on the beach unattended. Hazards You have chosen a beautiful holiday destination; however, there is no destination without its particular hazards. Isla Escape is a beachfront property with its beaches, waves, rocks, step-ups and downs, shallow and deep water, rough and calm seawater, sun, etc. So, although many hazards are equal to the ones at home, your holiday destination, like others, is not without inherent risks and appropriate care should be taken to prevent unpleasant disturbances of holidays. Take ample precautions, wear suitable comfortable slippers when walking outside, use sun protection, watch your steps and, if you are not a confident swimmer, use a life vest when snorkeling or when using the kayaks. Children may go for a walk and end up at the edge of the neighbor’s pool, etc. If you drive a car, make yourself acquainted with the local traffic rules and habits before you start driving. Driving in Mexico is safe but it is certainly different from driving at home. Tap water is not drinking water; drinking tap water may cause invasion of the body by bacteria that and may cause diarrhea. Responsibilities and waivers The principle responsible and his party acknowledge that neither Isla Escape.com nor its personnel, agents and the Object owner(s) have taken out personal or third party liability insurances to cover their undertakings in relation to Isla Escape.com and they cannot be held responsible regardless of defaults or defects in those undertakings causing third party harm. Isla Escape.com, its personnel, agents and Object owner(s) shall be protected and hold harmless against any claims resulting from accident, loss, damage, or injury, including death, incurred or resulting from or in connection with the rental and use of the Object. Same waiver applies to events and mishaps resulting from acts of God, fire, breakdowns, acts of governmental or other authorities having jurisdiction, social unrest, terrorist acts, riots, acts of war, theft, disease, etc. It is the responsibility of the principle responsible and his party to take out adequate travel- and health care insurance. In case of illness or accident causing injury, the principle and his party is responsible for obtaining their medical assistance. Take sufficient prescribed medicines with you. Getting prescriptions in Mexico is expensive and time consuming. Keys For replacement of a lost key a surcharge of USD 70,- applies to cover for lock changes. No Smoking and the use of open fire Isla Escape.com is a non-smoking holiday destination. The use of the BBQ is strictly in accordance with the instructions given by the management. Only gas fire shall be used when using the BBQ. "Camp fires" in the garden or on the beach are strictly forbidden. Statement The principle responsible and his party, understand/confirm the following:
